Divorce & Family Law

Hyman & Gilbert, Attorneys at Law provides assistance to clients going through divorce and other familial legal transactions.   The firm’s divorce and family law practice is primarily focused on:

Collaborative law

Collaborative law is a special type of dispute resolution system based on the idea that disputing parties can work together to reach a solution that all parties agree on.  It often reduces the amount of time and money spent on legal disputes.  The collaborative law attorneys at Hyman & Gilbert help clients settle disputes in a respectful, professional manner where a mutually agreed-upon decision represents the best interests of all involved.

Litigation

While the majority of cases settle in negotiation, sometime going to court is unavoidable.  The Westchester County attorneys of Hyman & Gilbert have the courtroom experience and legal finesse necessary to effectively argue cases.  They are strong advocates with a proven record of success.

Post judgments

Divorce does not always resolve all legal issues between ex-spouses.  In such cases, it is necessary to have a lawyer adept at renegotiating to adjust or reverse prior court decisions and agreements.  Hyman & Gilbert represents their New York clients in a variety of post judgment matters, including child support and property division cases.

Separation agreements and stipulations of settlements

A separation agreement in New York is a document where a married couple agrees to live apart from one another for the rest of their lives.  It specifies conditions regarding spousal or child support, custody arrangements, and property division both equitably and legally.  Hyman & Gilbert assists couples who wish to separate prepare documents in accordance with New York law.  When properly drafted, a separation agreement in New York allows a couple to obtain a conversion divorce after they have abided by the terms of the agreement for one (1) year.

Uncontested divorces

An uncontested divorce is an alternative to litigation.   All parties involved in an uncontested divorce agree on major decisions, from property division to child and spousal support.  In such cases, the attorneys of Hyman & Gilbert review and finalize divorce papers before they are filed.

Pre-nuptial agreements

Pre-nuptial agreements are tools for engaged couples with assets to create a plan for their future.  While not romantic, pre-nuptial agreements can help avert or shorten complex divorce proceedings should the marriage disintegrate.  Hyman & Gilbert assists clients through the process of drafting and validating pre-nuptial agreements that specifically address clients’ needs.   They make sure paperwork meets New York state’s requirements both in the drafting and the execution of the agreement.

Post-nuptial agreements

Similar to a pre-nuptial agreement, a post-nuptial agreement is a document stipulating what will happen when partners have issues post marriage.   Hyman & Gilbert’s lawyers frequently work with couples in the creation of post-nuptial agreements.
